Introduction

These Terms and Conditions govern all services provided by Hometown Restoration Group (“Company,” “we,” “us,” or “our”) to the customer (“Client,” “you,” or “your”). By scheduling, authorizing, or allowing any services to begin, you agree to be bound by these Terms and Conditions.

Scope of Services

Hometown Restoration Group provides property restoration and related services including but not limited to water damage mitigation, drying, cleanup, removal of affected materials, and other restoration related services as authorized by Client.

Only services specifically approved by Client are included. Additional services require separate authorization and may result in additional charges.

Authorization to Enter Property

Client authorizes Hometown Restoration Group to enter the property to inspect, monitor, and perform authorized services. Client confirms they have the legal authority to grant access to the property.

Emergency Services

Client understands that emergency services may begin immediately to prevent further damage. Once emergency services are initiated, certain costs and actions cannot be reversed or canceled.

Payment Responsibility

Client agrees that they are financially responsible for all services performed, regardless of insurance involvement.

- Payment is due upon completion of services unless otherwise agreed in writing.

- Insurance billing assistance is provided as a courtesy only.

- Client remains responsible for deductibles, denied charges, underpayments, or non covered services.

Late or unpaid balances may be subject to interest, fees, or collection actions as permitted by law.

Insurance Disclaimer

Hometown Restoration Group does not guarantee insurance approval, coverage determinations, or payment amounts. All insurance decisions are made solely by the insurance carrier.

Estimates are based on observable conditions and industry standards at the time of service and may change if additional damage is discovered.

No Guarantee of Results

Due to the nature of property damage, Hometown Restoration Group makes no guarantees regarding complete restoration, prevention of future damage, elimination of odors, or mold growth. Hidden damage, pre existing conditions, and environmental factors may affect outcomes.

Client Responsibilities

The Client agrees to provide reasonable and safe access to the property, maintain required utilities such as electricity and water when necessary, disclose known hazards or unsafe conditions, and secure or remove personal belongings when requested. Failure to meet these responsibilities may result in delays, additional charges, or suspension of services.

Equipment and Utility Usage

The Client acknowledges that restoration equipment may consume electricity, water, or other utilities and may increase utility usage or costs. Hometown Restoration Group is not responsible for utility expenses, service interruptions, or related issues resulting from equipment operation.

Limitation of Liability

To the fullest extent permitted by law, Hometown Restoration Group shall not be liable for pre existing or hidden damage, loss or damage to personal property, delays caused by third parties, utilities, weather, or access issues, or any indirect, incidental, or consequential damages. The total liability of Hometown Restoration Group shall not exceed the amount paid by the Client for the services performed.

Cancellation Policy

The Client understands that once services have begun, charges for labor, equipment, materials, emergency response, and setup may apply even if services are later stopped or canceled.

Health and Safety Disclaimer

Properties affected by water or other damage may contain contaminants such as bacteria, mold, or other hazardous substances. The Client acknowledges these risks and agrees that Hometown Restoration Group is not responsible for health related conditions arising from the damage or the property environment.

Authorization for Material Removal

The Client authorizes Hometown Restoration Group to remove affected materials such as drywall, flooring, insulation, cabinetry, or other building components when reasonably necessary to perform authorized services.

Right to Refuse or Discontinue Services

Hometown Restoration Group reserves the right to refuse or discontinue services if unsafe conditions exist, payment obligations are not met, cooperation is not provided, or circumstances prevent proper service delivery.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the state of TN, without regard to conflict of law principles.

Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Acceptance of Terms

By authorizing services verbally, electronically, or in writing, the customer confirms acceptance of these Terms and Conditions.
